1-3 - These general terms and conditions of sale apply to all items offered for sale on this site and are reserved for customers over 18 years of age who have their full legal capacity.

1-4 - Any order for one or more items presented on this site implies unreserved consultation and acceptance by the customer of these General Terms and Conditions of Sale (GTCs), as well as the rates applied. These general terms and conditions of sale prevail over any other document, as well as the general terms and conditions of sale of the customer's country.

1-5- Any breach by the company LADA FRANCE to one of its obligations mentioned in the general terms and conditions of sale cannot under any circumstances be interpreted by the customer as a waiver of the GTC. The said conditions may be updated or modified without notice and the conditions applied will then only be in force at the time the contract is concluded, i.e. the day the order is registered.

ARTICLE 2: INFORMATION RELATING TO ARTICLES

2-1 - Promotional products and offers present on the site are presented for sale within the limits of available stocks and for offers until their validity. The presence of an item on the site does not guarantee its availability in stocks.

2-2 - Photographs and any other illustrations of the articles are given only for information purposes; they are subject to change without notice and do not fall within the contractual scope.
Therefore, although represented on the site with the greatest accuracy, photos and texts may, however, have errors. In this case, responsibility for LADA FRANCE cannot be engaged.

2-3 - Products sold by LADA FRANCE may only be fitted to vehicles or systems recommended by the manufacturer or equipment supplier, by a competent person, and under their sole responsibility. LADA FRANCE will under no circumstances be held responsible for the consequences of misassembly or the use of an unsuitable product on a vehicle.

2-4 LADA FRANCE will honor orders within the limit of available stock at LADA FRANCE and its suppliers;in the event of unavailability of the product ordered, or in the event of non-acceptance by the customer of the delivery time imposed by this unavailability, LADA FRANCE will offer a replacement product to its customer, who will retain full discretion to accept or refuse it.In the event that the customer refuses the replacement product, LADA FRANCE cannot be held liable under any circumstances due to the unavailability of the product ordered in the manufacturer's supplier stock;in the event of unavailability of all or part of the order and refusal of the delivery time of the replacement products by the customer, reimbursement will be made by bank transfer to the account of the customer who placed the order, within 30 days from payment of the amount paid by the customer.

ARTICLE 3: ORDERING ITEMS

Items offered for sale are subject to availability; in case of unavailability of a product, the customer will be informed of this after placing his order by e-mail or by mail; the order will only be validated once the customer has paid the entire payment.

LADA FRANCE reserves the right to refuse certain orders deemed invalid.

3-2 - Order validation. If the customer wishes to purchase one or more products, he will have to select a model or its reference, define the quantity and click on the basket, and validate the selected products; the customer will identify himself, then choose his method of payment and proceed with the settlement.

ARTICLE 4: PRICES OF ARTICLES

4-1 The prices shown on the website are in euros all taxes included. Any change in the French VAT rate will be reflected in the price of the products presented on the site. The prices do not include the shipping and packing costs which are borne by the customer and which will be specified to the customer when the order is registered.

ARTICLE 5: PAYMENT AND SECURITY

5-1 - The entire payment must be made at the time of the order, at no time can the amounts paid be considered as hares or advance payments; the customer pays for his order, either by credit card, bank transfer, cash warrant or PayPal. The communication by the customer of his credit card number is valid for LADA FRANCE to debit his account up to the amount of his order.No cash on delivery can be made; LADA FRANCE retains ownership of the item until full payment of the price by the customer. Purchases are secured.

ARTICLE 6: DELIVERY

6-1 - Transport methods: orders can be delivered anywhere in France. LADA FRANCE reserves the right to choose the appropriate mode of transport. Orders will be delivered in France by Colissimo or other operators

6-2 - Delivery of the products will only be effective after receipt of the total amount of the order.The products will be delivered to the address indicated by the customer when placing the order, consequently the contact details provided by the customer are considered to be accurate and will not, in the event of a dispute, engage the liability of LADA FRANCE; in the event of the customer's absence on delivery, the carrier will leave a notice of departure at the address indicated.

6-3 - The average delivery time is 10 days, it is indicated only for information purposes and does not constitute a firm commitment from LADA FRANCE.

6-4 - Delivery in metropolitan France: the shipping costs indicated when placing the order only concern deliveries in metropolitan France.Delivery rates outside metropolitan France will be calculated as soon as the customer has specified the country in which they wish to be delivered.

6-5 - Receipt of products: the customer is advised to check the condition of the products received before signing the delivery note.Once the note has been signed, LADA FRANCE will consider that the customer has carried out this verification.

ARTICLE 7: WITHDRAWAL

7-1 - Under the provisions of Articles L 121-20 et seq. of the Consumer Code, the customer has a period of seven clear days to exercise his right of withdrawal without having to provide a reason, from the date of receipt of his order.The shipping and return costs are the responsibility of the customer;products accompanied by a bank account details slip from the customer for reimbursement must be returned by post, in perfect condition, and in the original packaging, including accessories and instructions for use, to the following address: LADA FRANCE 392 avenue Leonardo da Vinci 84700 SORGUES.
Refunds will be made by crediting the customer's account within 15 days.In the event of a damaged, incomplete or damaged product being returned, it will not be exchanged or refunded.

ARTICLE 8: CONFORMITY OF PRODUCTS

8-2 - Guarantee: the customer benefits from the legal provisions relating to the guarantee of hidden defects under article 1641 and following of the Civil Code.

ARTICLE 9: RETENTION OF TITLE AND TERMINATION CLAUSE

9-1 - The products ordered remain the property of LADA FRANCE until the customer has fulfilled his obligations, in particular that he complies with the full payment of the price; once ownership is transferred, the risk of loss, theft or deterioration of products is borne by the customer.

9-2 - If the buyer fails to fulfil any of its obligations, the sale will be terminated automatically and without warning; the items must be returned to LADA FRANCE within 48 hours.

ARTICLE 10: APPOINTMENT INFORMATION

10-1 - The customer expressly agrees to communicate to LADA FRANCE its personal data in order to manage orders and customer relations as best as possiblele.ConformIn accordance with the law of 6 january 1978 on information technology and freedoms, the customer has the right to access and rectify his personal data. For any addition or correction, it will be sufficient to send the new data by e-mail to ladafranceofficial@gmail.com or by letter to: LADA FRANCE 392 Avenue Blaise Pascal 84700 SORGUES.

LADA FRANCE undertakes not to disclose the customer's personal data to third parties and to comply with the European Data Protection Regulation.

ARTICLE 11: INTELLECTUAL PROPERTY

11-1 - In no case shall the customer be allowed to download or modify all or part of the site, including its content, listed products, descriptions, images, videos; any part of this site shall under no circumstances be reproduced, copied, sold or exploited for commercial reasons without the express and written authorization of LADA FRANCE.

In general all the products, copyrights, trademarks and other distinctive signs and property or intellectual property rights appearing on the site will remain the full property of LADA FRANCE.The customer is therefore required to respect intellectual property rights and may not use the brands appearing on the site and on the products, where applicable, or register a brand that would be detrimental to the rights holder, unless otherwise provided for in the contract;the same applies to any other intellectual property right.

ARTICLE 12: MAJOR FORCE

In the event of the occurrence of a force majeure event, the party concerned must inform the other party within 15 days of the occurrence of this event by registered letter with acknowledgement of receipt;expressly, the following are considered to be cases of force majeure or unforeseeable circumstances, in addition to those usually accepted by the case law of French courts and tribunals: total or partial strikes, riots, boycotts or other actions of an industrial nature, or commercial disputes, civil unrest, insurrections, war, bad weather, epidemics, blockages of means of transport or supply, for whatever reason, earthquakes, fires, storms, water damage, government restrictions, legal regulatory changes to forms of marketing, computer breakdowns, telecommunications blockages, any element beyond the control of the parties preventing the normal execution of the contractual relationship, all of the parties' obligations will be suspended for the entire duration of the force majeure event without compensation.

If the force majeure event continues for more than three months, the contract concerned may be terminated automatically without compensation for either party.
